LINCOLN, Neb. (AP) - The Nebraska Court of Appeals has upheld a jury verdict that sided with the widow of a driver involved in the 2012 fatal crash of a van carrying members of the Broken Bow High School basketball team.

The June 1, 2012, crash near Ansley in central Nebraska killed pickup truck driver Albert Sherbeck, 70, of Ansley, and two Broken Bow High School coaches in the van, Zane Harvey and Anthony Blum. The crash also seriously injured several students in the van.

Michael and Cathy Christensen, the parents of one of those students, sued Sherbeck's widow, Beverly Sherbeck, claiming her husband negligently caused the crash and that his estate should be held liable for damages. A jury found in favor of Sherbeck, agreeing that Albert Sherbeck had likely suffered a heart attack and sudden loss of consciousness before the crash. It awarded no damages to the Christensens.

Authorities had said an autopsy showed Albert Sherbeck had severe heart disease at the time of the crash and that he may have suffered a heart attack and lost consciousness before the crash.

The Christensens appealed the jury's verdict, and on Tuesday, the appeals court upheld it.

NORTH PLATTE, Neb.-A staple in the North Platte media scene will soon be moving on to another opportunity.

KNOP-TV News Director and anchor Jacque Harms tells The Post she will be moving to Meridian, Mississippi where she has accepted a position as General Manager of Gray Television's WTOK-TV.

Harms started with KNOP and the Carlini family in the early-80s while she was in High School, then returned in the 90s after attending Wayne State College and the University of Nebraska Lincoln.

Harms career includes jobs at KCAU-TV in Sioux City, Iowa, and KNEN-FM in Norfolk, Nebraska, and has included numerous awards from the Associated Press and the Nebraska Broadcasters Association.

"I'm absolutely thrilled for the opportunity," Harms said. "It's something I've been training to do for the last four years. I've just been waiting for the right market and timing."

Harms will make the transition sometime in June

Thanks to an anonymous donor and the Alice DeVoe Donor-Advised Fund, an affiliated fund of Nebraska Community Foundation, Nebraska’s homework gap is getting a little smaller.

Thirty-one Greater Nebraska schools are receiving grants totaling more than $263,000 through affiliated funds of Nebraska Community Foundation (NCF).&nbsp;<a>The opportunity for funding was made available exclusively to affiliated funds in the NCF network and required a 1:1 local funding match.</a>

“The homework gap has long existed, but COVID-19 has exacerbated the divide between Nebraska students,” said Jeff Yost, President &amp; CEO of Nebraska Community Foundation. “These grants support a wide range of methods to bridge the homework gap including computer equipment and software, internet access, staffing for summer school and individualized instruction for at-risk and special education students, transportation and professional development for trauma-informed practice.”

Of the 23 applications received, all were granted full funding by a volunteer Fund Advisory Committee whose members have vast experience in education and represent communities of all sizes across the state. Nebraska Community Foundation affiliated funds to receive funding for local schools include:

Nebraska Community Foundation affiliated funds aim to narrow homework gap

America is now opening back up. People are starting to venture back to church. Places of work are reopening. Restaurants are reopening. State parks are reopening. The beaches are opening many places. Most Americans are breathing a sigh of relief. Americans are sick and tired of Covid-19. We're tired of hearing about it and we're tired of the repercussions from it. More Americans now are unemployed since The Great Depression. More unemployment claims have been filed than ever before. Many Americans have filed for unemployment weeks ago and still haven't a penny of money. I continue to hear from people who haven't received a stimulus check. 

We are tired of the news and the latest countdown of every county's death stats from Covid-19. If you want to increase your risk of mental illness just keep watching television eight hours a day as many Americans have been doing.  In my town we have to hear about how many have died from every county in three states. Our hearts break and grieve for these families. It's just tough hearing the stats every day about so many counties in so many different states. 

What must be next? We must find a vaccine for Covid-19. We must develop it in our country if at all possible and we must not enrich China with billions of dollars with anything that comes out of that country. China has done and given us enough. We don't need more from China of anything. By the way, quit buying anything made from China.

Use commonsense! Be safe, be smart. Don't go to church if you don't want to! If you have health or age issues stay home or go walk the park. People in church are going to be in close proximity. It cannot be avoided totally. Hallways are narrow and restrooms are small at church. You are going to be close to somebody. You can go to church later. Pray at home, read your Bible at home and if you have any income you can mail your church a check. However, if you want to go to church then go but respect other people. Wear your mask for now and be distant. Be courteous. 

Go back to work if you still have a job. Your employer doesn't want you to be sick. Your employer is financially struggling now too. He wants to keep the factory or the business safe and healthy. They can't make it if everybody gets sick. Go to work and be a part of the solution. Don't be the problem. 

Go somewhere if you can. America and actually the entire planet are stir crazy. Keep your mask handy and wash your hands a lot. Carry your disinfectants with you. Clean everything often. Respect social distancing. Be safe.

Next, start thinking about how you are going to vote this fall. If you don't like how your elected leaders are leading then you can change it by voting.

NORTH PLATTE, Neb.-Mid-Plains Community College will offer more online classes than ever this summer in wake of the COVID-19 pandemic. A total of 97 online courses are planned – as compared to 80 a year ago.

It’s part of an effort by MPCC to safeguard students, faculty and staff and to allow students to continue their education from the comfort of their own homes should they choose to do so.

The fact that MPCC has steadily been increasing its Internet-based offerings for years puts it ahead of the game in addressing coronavirus concerns.

Online classes increased from 278 during the 2018-19 academic year to 313 online classes during the 2019-20 school year, and it’s a trend that’s likely to continue.

Alexa McCall, mathematics instructor, will offer a Math for Health Occupations class online this fall. The class is a prerequisite for nursing study.

<a>Similarly, biology instructor Dr. Leah Christensen will offer&nbsp;a section of Anatomy and Physiology I with a lab entirely&nbsp;online.</a>

“We have offered a non-lab Anatomy and Physiology class online for years, which is taken by students across the country,” said&nbsp;Christensen. “However, a two-semester Anatomy and Physiology I and II with lab sequence is required for many health care majors. Having an online-only option for those classes will provide us with another way to both meet the safety concerns of our students while also meeting them wherever they are physical, whether that is Benkelman or New York.”

From Christensen’s perspective, one of the biggest benefits to taking online classes from Mid-Plains, as opposed to a four-year college or university, is that the classes have the same low student-to-teacher ratio as in MPCC’s traditional classroom settings.

“That means we have just as much time for every student,” Christensen said. “Also, most of our online classes are taught by the same dedicated, full-time faculty that teach our in-person classes.”

One new COVID-19 case, Panhandle total positive count 75

OMAHA, Neb. (AP) - Nebraska on Tuesday opened polling places as the state held the nation's first in-person primary since&nbsp;<a href="https://apnews.com/41add9747778f3dd30dc7a6aa5b71ba5" target="_blank">a heavily criticized election in Wisconsin</a>&nbsp;five weeks ago in the middle of the&nbsp;<a href="https://apnews.com/e64f20bbacb7d48d15e1d76339220486" target="_blank">coronavirus</a>&nbsp;pandemic.

Polling places in the Omaha area appeared largely quiet, in part because there was such a huge number of absentee ballots mailed into election offices. Officials had encouraged people to vote by mail, though Republican Gov. Pete Ricketts and Secretary of State Bob Evnen both pledged to forge ahead with&nbsp;<a href="https://apnews.com/873960364e994cf0df6b762c028ca7eb" target="_blank">an in-person primary</a>&nbsp;even though many other states have rescheduled theirs or switched to all-mail voting.

Polling sites in the Omaha suburb of Papillion reported lower in-person turnout than normal Tuesday morning. At First Lutheran Church, voters who walked into the basement polling station had plenty of space to cast their ballots.

Michael Rabe, 68, of Papillion, said he wanted to vote in person because he doesn't trust mail-in voting but believes he had a civic duty to cast a ballot. Rabe wore a mask into the polling site, only to realize he was the only voter there at the time. The self-described "hardcore Republican" said he was most interested in voting for Matt Innis, a long-shot primary challenger to GOP U.S. Sen. Ben Sasse, who has been critical of President Donald Trump.

"I didn't like that when President Trump got into office, Sasse opposed him," Rabe said after voting. "I was not a Trump supporter when he was running, but now that he's our president, I am."

Douglas County Election Commissioner Brian Kruse, who oversees polling sites in Omaha, said in-person turnout was unusually low. He said he still expected strong turnout overall because of the huge number of mail-in ballots received, but "there's just nobody out there today" and the election has gone smoothly.

Ricketts ordered members of the Nebraska National Guard to provide on-call help at short-staffed polling sites in eight counties, including the Omaha and Lincoln areas. He said Guard members would be dressed in civilian clothes, not their normal uniforms.

"They'll be available to help out," he said.

Nebraska holds 1st in-person election in weeks amid pandemic

LINCOLN –&nbsp;Two deaths related to COVID-19 were reported to the Nebraska Department of Health and Human Services (DHHS) on Monday.

Further information is available related to three deaths recently reported by DHHS. Two reported Saturday were Dawson County residents. Both were women in their 50s and 60s. Both had been hospitalized and had underlying conditions.

The total number of COVID-19-related deaths in the state to date is 100, according to the DHHS data dashboard. The state case total, as of 5:45 p.m. Central Daylight Time, is 8,572. Nebraska's COVID-19 case totals are updated daily at&nbsp;<a href="http://dhhs.ne.gov/coronavirus">http://dhhs.ne.gov/coronavirus</a>.&nbsp;

Prescription Drug Collections return to North Platte

KEARNEY, Neb.-Troopers with the Nebraska State Patrol have arrested an Iowa man for multiple drug charges following a traffic stop on Interstate 80 near Kearney.

At approximately 7:00 p.m. Sunday, a trooper observed an eastbound Chevrolet Traverse driving on the shoulder near Kearney at mile marker 275. The trooper performed a traffic stop and detected clandestine activity. During the traffic stop, a K9 from the Kearney Police Department detected the odor of a controlled substance.

Troopers searched the vehicle and located 121 pounds of marijuana, 6 pounds of THC concentrate, 2 vials of steroids, a small amount of cocaine, and approximately $14,000 in cash.

The driver, Timothy Gorman, 37, of West Des Moines, Iowa, was arrested for two charges of possession of a controlled substance, possession of marijuana – more than one pound, possession with intent to deliver, and possession of money during a drug violation. Gorman was lodged in Buffalo County Jail.

The Governor also issued guidance to resume baseball and softball in June, with enhanced physical distancing measures in place for the safety of athletes, coaches, and spectators.&nbsp; Practices will be permitted starting on June 1st, and games can take place as of June 18th.&nbsp; Department of Education Commissioner Matthew Blomstedt joined Gov. Ricketts to talk about the resumption of youth sports.&nbsp; &nbsp;

Flags in Nebraska to fly at half-staff for Peace Officers Memorial Day

OMAHA, Neb. (AP) - Gov. Pete Ricketts pushed back Monday against four Nebraska lawmakers who urged him to cancel a $27 million coronavirus testing contract with a group of out-of-state startup companies, calling their criticism "ludicrous" even though the program hasn't kept up with demand.

Ricketts defended the state's agreement with Utah-based Nomi Health and its partnering companies but acknowledged some early problems with the&nbsp;<a href="https://www.testnebraska.com/en" target="_blank">TestNebraska&nbsp;</a>program. The same companies have similar no-bid contracts with Iowa and Utah that have come under scrutiny as states scramble to conduct more tests.

The senators - all Democrats in the officially nonpartisan Legislature - sent an open letter Monday to the Republican governor calling on him to spend the money on Nebraska-based public health labs and health care providers.

"During this economic crisis it is also vitally important that every dollar we have be prioritized for reinvestment into Nebraska to strengthen our existing health care infrastructure," said the letter signed by state Sens. Machaela Cavanaugh, Carol Blood, Megan Hunt and Rick Kolowski.

The senators said Nomi hasn't yet delivered the contractually required number of daily tests or met the 48-hour turnaround time for test results.

When Ricketts&nbsp;<a href="https://apnews.com/4680166177edf78b7f0ef9501f0efc6c" target="_blank">announced the contract</a>&nbsp;on April 21, he said the partnership would allow the state to test up to 3,000 residents per day after a five-week ramp-up period. The ramp-up started about three weeks ago and the companies haven't yet reached that goal. And in the hard-hit Grand Island area, some residents have waited longer than 48 hours for their results.

At his weekday coronavirus news conference, Ricketts said it wasn't practical to pump more money into Nebraska's permanent testing facilities at the state public health lab or the University of Nebraska Medical Center because both have reached their capacity and neither facility has space for additional equipment. He argued that state officials had to act quickly to secure the contract with Nomi and the other companies or they might have lost the opportunity to provide more tests.

"This is new for all of us, right?" Ricketts said. "You're not going to find a lot of companies that have tons of experience in testing in a pandemic, since this is the first one we've had in 100 years. So on the face of it, the senators' statement is ludicrous."

He later added: "I don't understand why they don't want more testing here in the state. We found a way to be able to do it. They should be happy we're doing more testing."

State officials have set up three mobile TestNebraska testing sites so far in hard-hit Omaha, Lincoln and Grand Island, using equipment and test kits purchased from the companies. A fourth site was set to open Monday in Schuyler.

Ricketts said the state received 2,358 test results from the sites last week, and 80 of those were positive for the virus.

He said demand for the tests overwhelmed the Lincoln and Omaha sites on Friday, and not everyone was able to get tested. Callers also overloaded the state's new TestNebraska hotline, which didn't have enough staff members to answer calls.

"We just ask for Nebraskans' patience as we go through this process," he said.

Meanwhile, Nebraska health officials reported two more COVID-19 deaths in the state in their daily briefing, bringing the state's death toll from the disease to 98.

Of the two deaths reported Sunday, one was in Douglas County. No information was immediately available on the second death.

The state also reported more confirmed cases of COVID-19. The Nebraska Department of Health and Human Services said the number of confirmed cases in the state increased by more than 80 on Sunday, to 8,315. The actual number of infections is thought to be far higher because many people have not been tested, and studies suggest people can be infected with the virus without feeling sick.

For some infected people, especially older adults and people with existing health problems, the virus can cause severe illness or death. But for most people, it causes mild or moderate symptoms, such as fever and cough, that clear up in two to three weeks.

Ricketts pushes back on criticism of TestNebraska contract

NORTH PLATTE, Neb.-Many parents and students are taking to social media to voice their disappointment in the sudden termination of the long-time Color Guard coach at North Platte High School.

With restrictions in place, many cheerleading squads, dance teams, singing groups, and other school teams and organizations have had to hold auditions virtually via video and other forms of technology.

North Platte High School Color Guard Coach Shannon Hudson decided to get a little bit creative, while still complying with social distancing guidelines.&nbsp;

According to numerous sources, students who were interested in auditioning for the Color Guard team, which performs with flags and other elements alongside the NPHS Marching Band at football games and other events, were able to sign up for an audition time.

At their scheduled time, the student would arrive at Hudson's home and perform their audition at the end of her driveway while Hudson recorded from a safe distance away. 

Students were scheduled one at a time, and at no time were social distancing guidelines violated, according to parents and students. The videos were then to be sent to Brett Bradley, NPHS band instructor, for review so that he and Hudson could select the 2020/2021 NPHS Color Guard Team.

According to one parent, North Platte Public Schools administrators learned of the audition process and immediately began the process of terminating Hudson from her coaching position. School officials reportedly stated that Hudson had violated policies and guidelines that have been implemented due to the coronavirus outbreak.

On Monday, Bradley notified NPHS Band families of the termination via email.&nbsp;

Bradley stated that Hudson had been relieved of her coaching duties effective immediately and asked anyone who may see Hudson to thank her for her years of service.

Hudson was on the NPHS Color Guard team for three years as a student and had coached the team for the past 18 years.

We have reached out to Hudson for comment, she has not responded.

North Platte Public Schools officials said via email, "Out of courtesy to all parties involved NPPSD does not comment on any personnel matter to those who are not directly involved."

Numerous parents stated that they plan to voice their concerns about Hudson's termination at the regularly scheduled North Platte Public Schools Board of Education meeting tonight at 5:30 p.m.

LINCOLN, Neb. (AP) - Two former employees of the Nebraska Department of Correctional Services did not retaliate against a prisoner who reported a sexual assault eight years ago by a prison guard, a judge has ruled.

The guard, Anthony Hansen, was eventually convicted of sexually assaulting the inmate in 2012 at the Omaha Correctional Center. But the lawsuit concerned the inmate's treatment after he reported the assault.

He alleged an interview of him and his subsequent placement in a segregated unit were punishment, The Omaha World-Herald&nbsp;<a href="https://www.omaha.com/news/crime/inmate-claimed-he-was-penalized-for-reporting-rape-by-nebraska-prison-guard-judge-says-otherwise/article_860a208f-ca8f-5181-b9fd-4edde8e2214f.html" target="_blank">reported</a>. He sued Michael Kenney, a former warden, and Geoff Britton, an investigator who is retired from the Nebraska corrections department.

District Judge Michael Coffey ruled the inmate was placed in the special housing unit at the Omaha Correctional Center for his protection, not as punishment. He said the unit has several restrictive housing situations but not all of them are punitive.

"In a situation where an inmate ... (is) the victim of a sexual assault, it is the best practice for the correctional facility to place the inmate in protective custody for his own protection," Coffey wrote.

The Central States Center for Agricultural Safety and Health (CS-CASH) at the University of Nebraska Medical Center, College of Public Health, in partnership with the Ag Health and Safety Alliance and the High Plains Intermountain Center for Agricultural Health and Safety have developed recommendations for conserving respiratory inventory while supplies are limited.

Reuse of two-strap disposable respirators is not recommended practice, but in a time of limited availability, it may need to be considered. This type of respirator should only be reused within the following guidelines:

UNMC ag center offers respiratory protection recommendations during COVID-19 pandemic

OMAHA, Neb.-Due to COVID-19 restrictions on public gatherings, Creighton University will hold a&nbsp;<a href="https://www.creighton.edu/commencement/" target="_blank">virtual degree-conferral ceremony</a>&nbsp;on Saturday, May 16, at 1 p.m., and will confer 2,205 degrees.
