have questions and concerns. Scammers take advantage of this opportunity

and you can keep all the same services. To get started, all you need to 
do is provide some personal information, such as your Medicare ID 
number. Of course, the call is a scam, and sharing personal information 
will open you up to identity theft.

In another common scam, callers try to frighten – rather than assist -
 victims with their health care plans. In this case, scammers claim that
 your Medicare will be discontinued if you didn't re-enroll. 
Fortunately, this “Medicare advisor” can fix the situation – if you 
share personal information with them.&nbsp;

Medicare, ACA scams abound during special enrollment period

The
 Federal Trade Commission is putting more than 1,100 businesses that 
pitch money-making ventures on notice that if they deceive or mislead 
consumers about potential earnings, the FTC won’t hesitate to use its 
authority to target them with large civil penalties.

As the 
pandemic has left many people in dire financial straits, money-making 
pitches have proliferated and gained special attention. From multi-level
 marketing companies offering the dream of owning a business, to 
investment “coaches” with promises of secrets on how to beat the odds, 
to ubiquitous “gigs” that pitch a steady second income, Americans are 
bombarded by offers that often prove to be less than advertised.

As
 a result, the FTC is deploying its Penalty Offense Authority to remind 
businesses of the law and deter them from breaking it. By sending a <a href="https://www.ftc.gov/system/files/attachments/penalty-offenses-concerning-money-making-opportunities/cover-letter-mmo.pdf">Notice of Penalty Offenses</a>&nbsp;to
 more than 1,100 companies, the agency is placing them on notice they 
could incur significant civil penalties—up to $43,792 per violation—if 
they or their representatives make claims about money-making 
opportunities that run counter to prior FTC administrative cases.

“Preying
 on consumers and workers with bogus promises of big earnings should 
never be profitable,” said Samuel Levine, Director of the FTC’s Bureau 
of Consumer Protection. “Today’s announcement helps ensure that 
companies that cheat struggling Americans will pay a heavy price.”

The
 Notice of Penalty Offenses allows the agency to seek civil penalties 
against a company that engages in conduct that it knows is unlawful, and
 that has been found unlawful in a previous FTC administrative order, 
other than a consent order.

The Notice sent to the companies 
outlines a number of practices that the FTC determined to be unfair or 
deceptive in prior administrative cases. Broadly, the cases found that 
it was unlawful to make false, misleading, or deceptive representations 
concerning the profits or earnings that may be anticipated by a 
participant in a money-making opportunity. This includes, for example, 
representations that participants will make a profit, or that 
represented profits are typical. The Notice also describes other 
practices that the FTC has determined to be unfair or deceptive, such as
 falsely telling consumers they do not need experience to earn income or
 that they must act immediately to participate. 

Companies receiving the Notice also received a copy of the recently issued <a href="https://www.ftc.gov/news-events/press-releases/2021/10/ftc-puts-hundreds-businesses-notice-about-fake-reviews-other">Notice of Penalty Offenses concerning endorsements and testimonials</a>,
 as companies frequently use testimonials to advertise money-making 
opportunities. Together, the notices make clear that it is illegal to 
use testimonials to mislead consumers about the rewards of participating
 in a money-making opportunity.

The notices are being sent to a 
broad array of businesses that cover a wide range of money-making 
opportunities, including multi-level marketing, “gig” employers, 
investment and business coaching, franchises, business opportunities, 
and others. A recipient’s presence on this list does not in any way suggest that it has engaged in deceptive or unfair conduct. FTC: Pitching a deceptive money-making scheme? Feds will target you

WASHINGTON (AP) — U.S. health advisers have endorsed kid-size doses of Pfizer's COVID-19 vaccine for younger children. The vote Tuesday by the Food and Drug Administration panel moves the U.S. closer to vaccinating children ages 5 to 11. 

The FDA isn’t bound by the panel’s recommendation and is expected to make its own decision within days. If regulators agree, shots could begin as early as late next week. Young kids would get a third of the dose given to teens and adults. A study found kid-size vaccinations are nearly 91% effective at preventing infections that cause symptoms. Moderna also is studying its vaccine for young children.

WASHINGTON (AP) — Kid-size doses of Pfizer’s COVID-19 vaccine may be getting closer as government advisers on Tuesday began deliberating whether there’s enough evidence that the shots are safe and effective for 5- to 11-year-olds.

A study of elementary schoolchildren found the Pfizer shots are nearly 91% effective at preventing symptomatic infection -- even though the youngsters received just a third of the dose given to teens and adults.

In a preliminary analysis last week, Food and Drug Administration reviewers said that protection would “clearly outweigh” the risk of a very rare side effect in almost all scenarios of the pandemic. Now FDA’s advisers are combing through that data to see if they agree.

If the FDA authorizes the kid-size doses, there’s still another step: Next week, the Centers for Disease Control and Prevention will have to decide whether to recommend the shots and which youngsters should get them.

While children are at lower risk of severe COVID-19 than older people, 5- to 11-year-olds still have faced substantial illness -- including over 8,300 hospitalizations, about a third requiring intensive care, and nearly 100 deaths, FDA vaccine chief Dr. Peter Marks told the advisory panel.

Also, "infections have caused many school closures and disrupted the education and socialization of children,” he said.

“I want to acknowledge the fact that there are strong feelings” among the public for and against child vaccinations, Marks added, noting that the discussion would be on scientific data "not about vaccine mandates, which are left to other entities outside of FDA.”

Full-strength shots made by Pfizer and its partner BioNTech already are recommended for everyone 12 and older but pediatricians and many parents are clamoring for protection for younger children. The extra-contagious delta variant has caused an alarming rise in pediatric infections -- and families are frustrated with school quarantines and having to say no to sleepovers and other rites of childhood to keep the virus at bay.

States are getting ready to roll out shots for little arms -- in special orange-capped vials to distinguish them from adult vaccine -- as soon as the government gives the OK. More than 25,000 pediatricians and other primary care providers have signed up so far to offer vaccination.

Pfizer’s study tracked 2,268 children ages 5 to 11 who got two shots three weeks apart of either a placebo or the kid dose. Vaccinated youngsters developed levels of virus-fighting antibodies just as strong as teens and young adults who got the full-strength shots.

And so far, 16 kids given dummy shots developed symptomatic COVID-19 compared to three vaccinated youngsters, meaning the vaccine was nearly 91% effective. Most of the study data was collected in the U.S. during August and September as the delta variant surged.

The kid dosage also proved safe, with similar or fewer temporary side effects — such as sore arms, fever or achiness — that teens experience. At FDA’s request, Pfizer more recently enrolled another 2,300 youngsters into the study, and preliminary safety data has shown no red flags.

The study isn’t large enough to detect any extremely rare side effects, such as the heart inflammation that occasionally occurs after the second dose, mostly in young men and teen boys.

The FDA's panel of independent experts will weigh whether Pfizer's shot is likely to prevent more COVID-19 hospitalizations in young kids than might be caused by that rare side effect.

The FDA analysis calculated that in most scenarios of the continuing pandemic, the vaccine would prevent roughly 200 to 250 COVID-19 hospitalizations for every 1 million youngsters vaccinated, with about 58 hospitalizations for the heart inflammation. The side effect risk is based on levels in teens, and Pfizer expects it to be far lower in youngsters getting the kid-size dose.

Amount spent on cigarette advertising increased from $7.62B in 2019 to $7.84B in 2020

The
 number of cigarettes that the largest cigarette companies in the United
 States sold to wholesalers and retailers nationwide increased from 
202.9 billion in 2019 to 203.7 billion in 2020, according to the most 
recent Federal Trade Commission <a href="https://www.ftc.gov/system/files/documents/reports/federal-trade-commission-cigarette-report-2020-smokeless-tobacco-report-2020/p114508fy20cigarettereport.pdf">Cigarette Report</a>. This represents the first time annual cigarette sales have increased in 20 years.

According to the <a href="https://www.ftc.gov/system/files/documents/reports/federal-trade-commission-cigarette-report-2020-smokeless-tobacco-report-2020/p114508fy20smokelesstobacco.pdf">2020 Smokeless Tobacco Report</a>,
 smokeless tobacco sales increased from 126.0 million pounds in 2019 to 
126.9 million pounds in 2020. The revenue from those sales rose from 
$4.53 billion in 2019 to $4.82 billion in 2020. For the first time, the 
Commission is reporting sales of nicotine lozenges or nicotine pouches 
not containing tobacco. In 2020, the companies sold 140.7 million units 
of such products in the United States, for $420.5 million.

The 
amount spent on cigarette advertising and promotion increased from $7.62
 billion in 2019 to $7.84 billion in 2020. Price discounts paid to 
cigarette retailers ($6.07 billion) and wholesalers ($876 million) were 
the two largest expenditure categories in 2020. Combined spending on 
price discounts accounted for 88.5 percent of industry spending.

Spending
 on advertising and promotion by the major manufacturers of smokeless 
tobacco products in the U.S. decreased from $576.1 million in 2019 to 
$567.3 million in 2020. As with cigarettes, price discounts made up the 
two largest spending categories, with $296.6 million paid to retailers 
and $83.5 million paid to wholesalers. Combined spending on price 
discounts totaled $380.1 million – or 67.4 percent of all spending in 
2020, up from the $376.0 million spent in 2019.

For the first 
time, the 2020 data include information on the flavors of the companies’
 smokeless tobacco products. Menthol flavored smokeless tobacco products
 comprised more than half of all sales revenues (54.5 percent); tobacco 
flavored products (that is, no added flavor) comprised 43.4 percent; and
 fruit flavored smokeless tobacco products comprised 2.5 percent.

The
 Commission has issued the Cigarette Report periodically since 1967 and 
the Smokeless Tobacco Report periodically since 1987. Given the 
concerning trends highlighted in this report, including the first 
increase in cigarette sales in two decades, the Commission will continue
 to expand its approach in reporting shifts in the tobacco industry. The
 FTC also will use the newly captured data regarding smokeless tobacco 
products to align the Commission’s enforcement efforts with the emergent
 realities in the tobacco industry.

Report: Cigarette sales up in US for first time in 20 years

OMAHA, Neb. (AP) — Police in Omaha have made an arrest in the shooting death earlier this month of an 18-year-old man.

 Police said in a news release that the Metro Area Fugitive Task Force arrested 19-year-old Justyn Wagner on Monday and booked him into the Douglas County Jail on suspicion of first-degree murder and weapons counts. 

Wagner is accused in the killing of 18-year-old KorVanta Hill. Officers called to the scene of the shooting on Oct. 18 found Hill mortally wounded on the sidewalk.

 The Battle Creek, Michigan-based company said Monday that it sent a message to the Bakery, Confectionery, Tobacco Workers and Grain Millers International Union that represents those workers offering to resume contract talks. 

The workers have been on strike since Oct. 5. Dan Osborn, president of the union’s local chapter in Omaha, Nebraska, said he believes the union is ready to return to the bargaining table if the company is willing to negotiate on its two-tiered wage system that offers newer employees less pay and fewer benefits.

FORD COUNTY—A Kansas boy died in an accident just after 7p.m. Monday in Ford County.

The Kansas Highway Patrol reported&nbsp; 8-year-old Nicholas Williams of Offerle was driving a 2004 Honda TRX 400 ATV in the 10600 Block of 134th Road south of Garnett Road.&nbsp; At a field entrance the ATV overturned.

Williams died of his injuries. According to the KHP, the boy was not wearing a helmet.&nbsp;

WASHINGTON (AP) — Children under 18 and people from dozens of countries with a shortage of vaccines will be exempt from new rules that will require most travelers to the United States be vaccinated against COVID-19, the Biden administration announced Monday.

The government will require airlines to collect contact information on passengers regardless of whether they have been vaccinated to help with contact tracing, if that becomes necessary.

Beginning Nov. 8, foreign, non-immigrant adults traveling to the United States will need to be fully vaccinated, with only limited exceptions, and all travelers will need to be tested for the virus before boarding a plane to the U.S. There will be tightened restrictions for American and foreign citizens who are not fully vaccinated.

The new policy comes as the Biden administration moves away from restrictions that ban non-essential travel from several dozen countries — most of Europe, China, Brazil, South Africa, India and Iran — and instead focuses on classifying individuals by the risk they pose to others.

It also reflects the White House’s embrace of vaccination requirements as a tool to push more Americans to get the shots by making it inconvenient to remain unvaccinated.

Under the policy, those who are vaccinated will need to show proof of a negative COVID-19 test within three days of travel, while the unvaccinated must present a test taken within one day of travel.

Children under 18 will not be required to be fully vaccinated because of delays in making them eligible for vaccines in many places. They will still need to take a COVID-19 test unless they are 2 or younger.

Others who will be exempt from the vaccination requirement include people who participated in COVID-19 clinical trials, who had severe allergic reactions to the vaccines, or are from a country where shots are not widely available.

That latter category will cover people from countries with vaccination rates below 10% of adults. They may be admitted to the U.S. with a government letter authorizing travel for a compelling reason and not just for tourism, a senior administration official said. The official estimated that there are about 50 such countries.

The U.S. will accept any vaccine approved for regular or emergency use by the U.S. Food and Drug Administration or the World Health Organization. That includes Pfizer, Moderna, Johnson &amp; Johnson, AstraZeneca and China’s Sinopharm and Sinovac vaccines. Mixing-and-matching of approved shots will be permitted.

The Biden administration has been working with airlines, who will be required to enforce the new procedures. Airlines will be required to verify vaccine records and match them against identity information.

Quarantine officers from the Centers for Disease Control and Prevention will spot-check passengers who arrive in the U.S. for compliance, according to an administration official. Airlines that don’t enforce the requirements could be subject to penalties of up to nearly $35,000 per violation.

The new rules will replace restrictions that began in January 2020, when President Donald Trump banned most&nbsp;<a href="https://apnews.com/article/united-nations-donald-trump-us-news-ap-top-news-virus-outbreak-9e22f8aabe2f454593b9f9b4c67eb31f">non-U.S. citizens coming from China</a>. The Trump administration expanded that to cover Brazil, Iran, the United Kingdom, Ireland and most of continental Europe. President Joe Biden left those bans in place and expanded them to South Africa and India.

Biden came under pressure from European allies to drop the restrictions, particularly after many European countries eased limits on American visitors.

“The United States is open for business with all the promise and potential America has to offer,” Transportation Secretary Gina Raimondo said after Monday’s announcement.

The main trade group for the U.S. airline industry praised the administration’s decision.

“We have seen an increase in ticket sales for international travel over the past weeks, and are eager to begin safely reuniting the countless families, friends and colleagues who have not seen each other in nearly two years, if not longer,” Airlines for America said in a statement.

The pandemic and resulting travel restrictions have caused international travel to plunge. U.S. and foreign airlines plan to operate about 14,000 flights across the Atlantic this month, just over half the 29,000 flights they operated during October 2019, according to data from aviation-research firm Cirium.

Henry Harteveldt, a travel-industry analyst in San Francisco, said the lifting of country-specific restrictions will help, but it will be tempered by the vaccination and testing requirements.

“Anyone hoping for an explosion of international inbound visitors will be disappointed,” he said. “Nov. 8 will be the start of the international travel recovery in the U.S., but I don’t believe we see full recovery until 2023 at the earliest.”

The Biden administration has not proposed a vaccination requirement for domestic travel, which the airlines oppose fiercely, saying it would be impractical because of the large number of passengers who fly within the U.S. every day.

COLUMBUS, Ohio (AP) — Ohio’s top lawyer has filed suit against the Biden administration seeking to restore a Trump-era ban on abortion referrals by family planning clinics that was reversed earlier this month. 

The action by Republican Attorney Dave Yost was joined by 11 other states. 

It says new federal regulations at the Department of Health and Human Services that return the Title X federal family planning program to the way it ran under the Obama administration prevents states from determining violations of a federal prohibition on clinics using taxpayer money for abortions.

Biden sued over reversal of Trump-era abortion referral ban

PLATTSMOUTH, Neb. (AP) — Authorities say human remains found in a park earlier this month were those of a Plattsmouth man who disappeared last year. 

Plattsmouth police and the Nebraska State Patrol confirmed Monday that the remains were 29-year-old Dalton Berens of Plattsmouth. 

Berens was reported missing in February 2020. His remains were found last week in a wooded area of Ryhlander Park in Plattsmouth close to where he lived. 

The cause of his death and the circumstances leading to his disappearance are still under investigation.

Troopers with the Nebraska State Patrol have arrested two people after locating more than 130 pounds of marijuana and a loaded handgun during a traffic stop on Interstate 80.

Friday, October 22, at approximately 1:50 p.m., a trooper observed an eastbound Mitsubishi Outlander following another vehicle too closely on Interstate 80 near Aurora, at mile marker 327. During the traffic stop, the trooper detected the odor of marijuana coming from inside the vehicle.

A search of the vehicle revealed 132 pounds of marijuana in several duffel bags in the rear of the vehicle. The Trooper also located a loaded handgun in the passenger door compartment.

The driver, Darius Rice, 24, and passenger, Alexus Webber, 21, both of&nbsp; Columbia, South Carolina, were arrested for possession of marijuana – more than one pound, possession with intent to deliver, no drug tax stamp, and possession of a firearm during a drug violation. Both were lodged in Hamilton County Jail.

News Release Nebraska State PatrolTroopers with the Nebraska State Patrol have arrested two people after locating more than 130 pounds of marijuana and a loaded handgun during a traffic stop on Interstate 80.Friday, October 22, at approximately 1:50 p.m., a trooper observed an eastbound Mitsubishi Outlander following another vehicle too closely on Interstate 80 near Aurora, at mile marker 327. During the traffic stop, the trooper detected the odor of marijuana coming from inside the vehicle.A search of the vehicle revealed 132 pounds of marijuana in several duffel bags in the rear of the vehicle. The Trooper also located a loaded handgun in the passenger door compartment.The driver, Darius Rice, 24, and passenger, Alexus Webber, 21, both of&nbsp; Columbia, South Carolina, were arrested for possession of marijuana – more than one pound, possession with intent to deliver, no drug tax stamp, and possession of a firearm during a drug violation. Both were lodged in Hamilton County Jail.

WASHINGTON (AP) — To supporters of the child tax credit, there has always been an “aha moment” — the recognition that as little as a few hundred dollars a month could be life-changing.

For Colorado Sen. Michael Bennet, it was several years ago when he was working as Denver’s school superintendent. One high schooler kept falling asleep in morning classes. When Bennet asked why he was so exhausted, the student said he worked the midnight shift at McDonald’s so that his family had enough money.

For Connecticut Rep. Rosa DeLauro, it was the childhood memory of her parents being evicted and finding their furniture on the street.

Bennet and DeLauro are among the Democratic lawmakers who have pushed to make permanent an expanded child tax credit, which President Joe Biden’s coronavirus relief package transformed into a monthly payment that would be available to almost any child. But Biden could not convince even enough of his fellow Democrats that they should extend these payments through 2025, and in negotiations for his broader package of economic and social programs he appears to have settled for a one-year extension that runs through next year.

Despite the concession, the president is still fighting for a legacy-making policy that could become the equivalent of Social Security for children. Biden dubbed the start of payments in July as “historic,” saying that the reduction to child poverty would be transformative and that he intended to make the credit permanent.

The steady evolution of the child tax credit reflects a fundamental split on how lawmakers think about human nature. Do payments from the government make people lazier or give them the resources to become more responsible? Established with bipartisan support in 1997, the credit has changed in ways that challenge many of the assumptions of political identities, as Democrats would be the ones calling on Republicans to cut taxes.

Republican critics and West Virginia Sen. Joe Manchin — the decisive Democratic vote — worry that the payments could discourage parents from working, while supporters say the money would make it easier to afford the child care and transportation needed to find jobs.

“It’s a flat-out tax cut for ordinary people,” Biden said in a Wednesday speech in Scranton. “That’s what it does. I make no apologies for it.”

The continuation of the payments of at least $300 a month per child is as much about a political transformation as an economic one.

For the purposes of the federal budget, it is a tax cut aimed squarely at the middle class as median family incomes are at $86,372. The credit’s evolution since being created in 1997 speaks to the power of using the tax code for social policy.

It allows Democrats to claim the mantle of middle-class tax cutters, while Republicans who oppose the idea could be criticized for favoring tax hikes on this key group of voters ahead of the 2022 elections. That is a sharp reversal from the Ronald Reagan-era identity of Republicans as committed to tax cuts for aiding growth.

“A lot of its initial success was that it did fit into the frame of tax relief,” said Gene Sperling, a Biden aide who worked on economic policy in both the Clinton and Obama White Houses. “This is one place where progressives have over a period of 30 years kind of won the conceptual war.”

The child tax credit was initially bipartisan, a unique policy overlap between former President Bill Clinton and former House Speaker Newt Gingrich.

Republicans made it part of their 1994 “Contract with America,” a list of polices that former Georgia Rep. Gingrich rode to the House speakership. Gingrich said in an interview that former Illinois Rep. Henry Hyde, a staunch abortion opponent, emphasized that the GOP needed to show that it cared about children after they were born, not just when they were in the womb. The tax credit was the chosen vehicle.

Clinton separately proposed it in December 1994 in his “middle class bill of rights” speech. The convergence ultimately led to the 1997 overhaul of welfare that established a $500 tax credit for children. Future administrations expanded the credit. But until this year the credit was not “fully refundable” — which meant that parents with low incomes might not earn enough to receive the full payment.

What Biden and Democratic lawmakers did with their coronavirus relief package was remove that limit, effectively turning the tax credit into a monthly child allowance. Their planned extension would make this change permanent.

Gingrich and Republicans say people would quit their jobs because they would be able to receive payments without working, depriving children of working parents who can serve as role models.

He calls that “an enormously dangerous thing for our culture.”

Backing that argument is a paper by University of Chicago economists that assumes the expanded tax credits would cause 1.5 million parents to ditch their jobs because the credits would no longer be tied to working.

“It’s a policy that’s been transformed from one that encourages self reliance and work to one that doesn’t,” said Bruce Meyer, the University of Chicago professor who co-wrote the analysis.

However, real world economic data shows no correlation between the payments and people leaving work so far. Researchers at Columbia University have found that the expanded child tax credit payments that began in July had no impact on labor and that models claiming otherwise are overly simplified. Workers often need to spend money in order to get a job, they reason.

“You have to make an investment in order to be able to work,” said Elizabeth Ananat, an economist at Barnard College who co-wrote the Columbia paper. “You do have to get your car fixed. You have to get your phone turned back on. You have to buy a month supply of diapers in order to secure your spot in the preschool.”

Democratic lawmakers believe the payments reduce poverty and improve educational outcomes, making it more likely that the children will hold steady jobs as adults.

Colorado Sen. Bennet backed the idea of a child tax credit after he found as a school administrator that more resources were needed to ensure kids had the stability to succeed.

“Most of the parents are working incredibly hard, some of them working two and three jobs. And no matter what they do, they couldn’t keep the kids out of poverty,” Bennet said.

DeLauro says the breakthrough on expanding the credit came as a result of the coronavirus showing how economically fragile many families are and Biden’s own choice as a presidential candidate to support the policy. She believes that beneficiaries will keep their jobs because work is part of who they are.

“People identify themselves by their work,” she said.

Child tax credit tussle reflects debate over work incentives

OMAHA, Neb. (AP) — A Waterloo volunteer firefighter has been charged with sexual assault after authorities say he drugged a woman and attacked her while she was incapacitated. 

The Douglas County Attorney has charged 27-year-old Brandon Hanusek with first-degree sexual assault of a mentally or physically incompetent person. 

Waterloo Volunteer Fire Department Chief Travis Harlow said he placed Hanusek on administrative leave after he was charged in May. 

Hanusek posted $2.500 bond after he was arrested in early June and he remains free while the case is pending.

Police said a 51-year-old woman from Kansas City was crossing the highway in a wheelchair when she was hit by a westbound Honda SUV.

The woman died at the scene of the crash.

employees who have reached age 59 ½ or the plan's normal retirement age.

With the COVID-19 pandemic, many employers, including governmental 
employers (such as public school districts), are looking for ways to 
encourage retirees to return to the workforce to fill open positions and
 experienced employees to stay on the job.

The IRS is providing help to these employers in <a href="https://www.irs.gov/newsroom/coronavirus-related-relief-for-retirement-plans-and-iras-questions-and-answers#rehires">two new frequently asked questions (FAQs)</a>,
 designed to offer technical guidance to public and private employers 
who sponsor pension plans for their employees. The FAQs highlight 
existing ways that employers can meet their employment objectives and 
still comply with the plan qualification rules.

Under the FAQs, an employer can generally choose to address 
unforeseen hiring needs by rehiring former employees, even if those 
employees have already retired and begun receiving pension benefit 
payments. Also, if permitted under plan terms, those employees may 
continue receiving the benefits after they are rehired. Moreover, an 
employer can generally choose to make retirement distributions available
 to existing employees who have reached age 59 ½ or the plan's normal 
retirement age. This may assist in the retention of employees eligible 
for retirement.

Employers get help from feds rehiring retired workers, retaining older workers

KERRVILLE, Texas (AP) — Authorities say a driver lost control during a Texas drag racing event and slammed into a crowd of spectators, killing two children and injuring eight other people. 

A 6-year-old boy and an 8-year-old boy were killed Saturday at an event called “Airport Race Wars 2” at the Kerrville-Kerr County Airport. 

The organized event was attended by thousands and involved drivers speeding down a runway as they competed for cash. 

The injured victims were taken to various hospitals, including a 46-year-old woman who was in critical condition. The majority of the other injuries are not believed to be life-threatening.

 Kerville is about 60 miles northwest of San Antonio.

Texas drag race driver slams into spectators, killing 2 kids

OMAHA, Neb. (AP) — Authorities say an Omaha police officer exchanged gunfire with a suspect in the theft of catalytic converters.

 Neither the officer nor the 17-year-old youth he was pursuing were struck by the bullets. 

Police say that officers responded to a 911 call that two males were attempting to steal a catalytic converter from a vehicle in the apartment parking lot.

 As officers approached, three males exited the vehicle and began to run with officers in foot pursuit. One suspect fired multiple rounds. The officer fired three rounds. 

The teen threw his firearm to his side after being given verbal commands. 

He was taken into custody without further incident. Three other male suspects were also taken into custody.

WASHINGTON (AP) — The Supreme Court is allowing&nbsp;<a href="https://apnews.com/article/texas-health-abortion-government-and-politics-ba02cd7c3f02b1eb5c87094257ee4db2">the Texas law that bans most abortions</a>&nbsp;to remain in place, but has agreed to hear arguments in the case in early November.

The justices said Friday they will decide whether the Justice Department and abortion providers can sue in federal court over a law that Justice Sonia Sotomayor said was “enacted in open disregard of the constitutional rights of women seeking abortion care in Texas.”

Answering that question will help determine whether the law should be blocked while legal challenges continue. The court is moving at an unusually fast pace that suggests it plans to make a decision quickly. Arguments are set for Nov. 1.

The court’s&nbsp;<a href="https://www.supremecourt.gov/opinions/21pdf/21a85_5h25.pdf" target="_blank">action</a>&nbsp;leaves in place for the time being a law that clinics say has led to an 80% reduction in abortions in the nation’s second-largest state.

The justices said in their order that they were deferring action on a request from the Justice Department to put the law on hold. Sotomayor wrote that she would have blocked the law now.

It takes just four justices to decide to hear a case.The court first declined to block the law in September, in response to an emergency filing by the abortion providers. The vote was 5-4 vote, with the three appointees of former President Donald Trump joining two other conservatives in the majority. Chief Justice John Roberts joined Sotomayor and the other two liberal justices in voting to keep the law on hold while the legal fight goes on in lower courts.Now, though, the justices, in a rare move, have decided to weigh in before lower courts definitively decide the issues.Kimberlyn Schwartz, a spokeswoman for Texas Right to Life, said she was happy the law remains in effect. “This is a great development for the Pro-Life movement because the law will continue to save an estimated 100 babies per day, and because the justices will actually discuss whether these lawsuits are valid in the first place,” Schwartz said in a statement.Amy Hagstrom Miller, the chief executive of Whole Woman’s Health, said Friday’s order means patients will continue to be denied care at her four clinics in Texas, on top of the hundreds who already have been turned away. Providers say the ability of Texas’ nearly two dozen clinics to stay open is threatened the longer the law stays in effect, although Hagstrom Miller said she was not aware of any imminent closures.But she said clinics are trying “to band together and get resources” to keep doors open. In 2013, another restrictive Texas anti-abortion law led to the closing of half the state’s 40-plus clinics. The Supreme Court ultimately struck down that law in 2016, but some clinics never reopened.“It’s a matter of time if this law continues to be enforced,” Hagstrom Miller said. “It will cause clinics to close and further decimate the fabric of care that is needed to take care of people across the state.”The law has been in effect since September, aside from a district court-ordered pause that lasted just 48 hours, and bans abortions once cardiac activity is detected, usually around six weeks and before some women know they are pregnant.That’s well before the Supreme Court’s major abortion decisions allow states to prohibit abortion,&nbsp;<a href="https://apnews.com/article/supreme-court-abortion-15-week-ban-5d066a9dc0030a4f8297711f341c9f5a">although the court has agreed to hear an appeal from Mississippi asking it to overrule those decisions, in Roe v. Wade and Planned Parenthood v. Casey</a>.But the Texas law was written to evade early federal court review by putting enforcement of it into the hands of private citizens, rather than state officials.The focus of the high court arguments will not be on the abortion ban, but whether the Justice Department and the providers can sue and obtain a court order that effectively prevents the law from being enforced, the Supreme Court said in its brief order.If the law stays in effect, “no decision of this Court is safe. States need not comply with, or even challenge, precedents with which they disagree. They may simply outlaw the exercise of whatever rights they disfavor,” the Biden administration wrote in a brief filed earlier in the day.Other state-enforced bans on abortion before the point at which a fetus can survive outside the womb, around 24 weeks, have been blocked by courts because they conflict with Supreme Court precedents.“Texas should not obtain a different result simply by pairing its unconstitutional law with an unprecedented enforcement scheme designed to evade the traditional mechanisms for judicial review,” the administration wrote.A day earlier, the&nbsp;<a href="https://www.supremecourt.gov/DocketPDF/21/21A85/197064/20211021113524436_21A85_United%20States%20v.%20Texas_Opposition.pdf" target="_blank">state urged the court to leave the law in place</a>, saying the federal government lacked the authority to file its lawsuit challenging the Texas ban.The Justice Department filed suit over the law after the Supreme Court rejected the earlier effort by abortion providers to put the measure on hold temporarily.In early October, U.S. District Judge Robert Pitman ruled for the administration, putting the law on hold and allowing abortions to resume.Two days later, a three-judge panel of the 5th U.S. Circuit Court of Appeals put the law back into effect.The court already is hearing arguments on Dec. 1 in&nbsp;<a href="https://apnews.com/article/abortion-health-courts-coronavirus-pandemic-us-supreme-court-b2399021aa925d655be3942c8e2edd2b">the Mississippi case</a>&nbsp;in which that state is calling for the court to overrule the Roe and Casey decisions.___
