North Platte man sentenced to prison for 2020 shooting

NORTH PLATTE, Neb.-A North Platte man has been sentenced to prison for shooting a man at a North Platte trailer park in 2020.

On Monday, Brayden Divine, 24, appeared for sentencing in Lincoln County District Court on one count of 2nd-degree assault.

According to prosecutors, on Dec. 26, 2020, at 8:11 p.m., officers were dispatched to the 2300 Block of East Philip on a report of gunshots. As officers were responding to the scene, it was reported that a subject with a gunshot wound had just arrived at Great Plains Health.

Police say during the investigation, officers learned that the 18-year-old victim was involved in a disturbance at a residence, in the 2300 Block of East Philip, with 22-year-old Brayden Divine and 20-year-old Logan Divine.  It was reported that a handgun was brandished inside the residence during the argument, and the victim was told to leave.  

The victim left the residence, and as he was leaving in a vehicle, he was shot in the leg.  Officers located the victim’s vehicle in the parking lot of Great Plains Health and observed evidence to support these statements.  

Police say that based on statements and evidence located at both the scene and the hospital, probable cause was established to arrest Brayden Divine on suspicion of 1st-degree assault, use of a deadly weapon to commit a felony, and discharging a firearm at an occupied vehicle.

As part of a plea agreement, one count of use of a firearm to commit a felony was amended to 2nd-degree assault. Two other counts, discharge of a firearm near a vehicle and 1st-degree assault, were dismissed.

Judge Michael Piccolo sentenced Divine to two to four years in prison with credit for four days already served in jail.

Divine was remanded to the custody of the Nebraska Department of Corrections to begin serving his sentence.

The victim has since recovered.
