Grand Jury for the District of Nebraska

Acting United States Attorney Steven Russell announced the federal Grand Jury for the District of Nebraska has returned 24 unsealed Indictments charging 26 defendants. Indictments are charging documents that contain one or more individual counts that are merely accusations, and every defendant is presumed innocent unless and until proven guilty.
* Massey Allen, age 41, of Omaha, is charged with distribution of 50 grams or more of methamphetamine (mixture) on or about July 7, 2022. The penalty if convicted is not less than 5 years’ and up to a 40 years’ imprisonment, a $5,000,000 fine, not less than four-years and up to life term of supervised release, and a $100 special assessment.
* Jacobo Alvarado Avila, a/k/a Jacobo Alvarado, a/k/a Jacabo Alvarez, age 39, is charged with reentry of a removed alien after having been convicted of an aggravated felony conviction on or about June 26, 2022. The maximum possible penalty if convicted is 20 years’ imprisonment, a $250,000 fine, a three-year term of supervised release, and a $100 special assessment.
* Trentelle Clifton, age 45, is charged with felon in possession of a firearm on or about July 6, 2022. The maximum possible penalty if convicted is 10 years’ imprisonment, a $250,000 fine, a three-year term of supervised release, and a $100 special assessment.
* Federico Cortez, a/k/a Federico Cortes, age 34, is charged in a two count Indictment. Count I charges Cortez with a felon in possession of a firearm on or about July 7 2022. The maximum possible penalty if convicted is 10 years’ imprisonment, a $250,000 fine, a three-year term of supervised release, and a $100 special assessment. Count II charges Cortez with possession of a stolen firearm on or about July 7, 2022. The maximum possible penalty if convicted is 10 years’ imprisonment, a $250,000 fine, a three-year term of supervised release, and a $100 special assessment.
* Cecilio Cruz-Chavez, age 34, is charged with reentry of a removed alien after an aggravated felony conviction on or about May 2, 2022. The maximum possible penalty if convicted is 20 years’ imprisonment, a $250,000 fine, a three-year term of supervised release, and a $100 special assessment.
* Javier De Leon Marin, age 31, and Gerson B. Ortega-Corado, age 24, are charged in a four-count Indictment. Count I charges De Leon Marin and Ortega-Corado with conspiracy to distribute and possession with intent to distribute 50 grams or more of methamphetamine (actual) on or about April 11, 2022 and continuing to on or about June 16, 2022. The penalty if convicted is not less than 10 years’ and up to life imprisonment, a $10,000,000 fine, not less than 5 years and up to a life term of supervised release, and a $100 special assessment. Count II charges Ortega-Corado with distribution of 50 grams or more of methamphetamine (mixture) on or about April 11, 2022. The penalty if convicted is not less than 5 years’ and up to 40 years’ imprisonment, a $5,000,000 fine, not less than 4 years and up to a life term of supervised release, and a $100 special assessment. Count III charges De Leon Marin with distribution of methamphetamine (actual) on or about May 18, 2022. The penalty if convicted is 10 years’ and up to a life imprisonment, a $10,000,000 fine, not less than 5 years and up to a life term of supervised release, and a $100 special assessment. Count IV charges De Leon Marin and Ortega-Corado with possession with intent to distribute 500 grams or more of methamphetamine (mixture) on or about June 16, 2022. The penalty if convicted is not less than 10 years’ and up to life imprisonment, a $10,000,000 fine, not less than 5 years and up to a life term of supervised release, and a $100 special assessment. There is also an allegation to forfeit United States currency seized on or about May 26, 2022.
* Christopher Frater, age 29, is charged with possession with intent to distribute of 5 kilograms or more of cocaine on or about July 13, 2022. The penalty if convicted is not less than 10 years’ and up to life imprisonment, a $10,000,000 fine, not less than five-years and up to life term of supervised release, and a $100 special assessment.
* Aaron Garcia-Patlan, age 33, is charged with illegal reentry of a removed alien after a felony on or about June 6, 2022. The maximum possible penalty if convicted is 10 years’ imprisonment, a $250,000 fine, a three-year term of supervised release, and a $100 special assessment.
* Krisman Gatdet, age 34, of Omaha, is charged in a three-count Indictment. Count I charges Gatdet with bank robbery on or about June 1, 2022. The maximum possible penalty if convicted is 20 years’ imprisonment, a $250,000 fine, a three-year term of supervised release, and a $100 special assessment. Count II charges Gatdet with attempted bank robbery on or about June 10, 2022. The maximum possible penalty if convicted is 20 years’ imprisonment, a $250,000 fine, a three-year term of supervised release, and a $100 special assessment. Count III charges Gatdet with bank robbery on or about June 13, 2022. The maximum possible penalty if convicted is 20 years’ imprisonment. a $250,000 fine, a three-year term of supervised release, and a $100 special assessment.
* Andrew Gilkerson, age 32, is charged in a two-count Indictment. Count I charges Gilkerson with conspiracy to distribute and possession with intent to distribute 50 grams or more of methamphetamine (actual) on or about July 21, 2021 and continuing to on or about January 27, 2022. The penalty if convicted is not less than 15 years’ and up to life imprisonment, a $20,000,000 fine, not less than 10 years and up to a life term of supervised release, and a $100 special assessment. Count II charges Gilkerson with distribution of 50 grams or more of methamphetamine (actual) on or about January 27, 2022. The penalty if convicted is not less than 15 years’ and up to life imprisonment, a $20,000,000 fine, not less than 10 years and up to a life term of supervised release, and a $100 special assessment. There is also an allegation to forfeit United States currency seized on or about January 27, 2022.
* Quintan J. Kimbrough, age 32, is charged with prohibited person in possession of a firearm on or about June 10, 2022. The maximum possible penalty if convicted is 10 years’ imprisonment, a $250,000 fine, a three-year term of supervised release, and a $100 special assessment.
* Daniel D. Konruff, age 43, of Gurley, Nebraska, is charged in a two-count Indictment. Count I charges Konruff with receipt of child pornography on or about March 21, 2022 and continuing to on or about May 13, 2022. The penalty if convicted is not less than 15 years and up to 40 years’ imprisonment, a $250,000 fine, not less than five-years’ and up to life term of supervised release, a $100 special assessment a $40,000 Special Assessment. Count II charges Konruff with possession of child pornography on or about May 13, 2022. The penalty if convicted is not less than 10 years and up to 20 years’ imprisonment, a $250,000 fine, not less than five-years’ and up to life term of supervised release, a $100 special assessment a $22,000 Special Assessment.
* Antonio Lopez Paiz, age 37, is charged in a three-count Indictment. Count I charges Lopez Paiz with false representation of a social security number on or about June 29, 2022. The maximum possible penalty if convicted is 5 years’ imprisonment, a $250,000 fine, a three-year term of supervised release, and a $100 special assessment. Count II charges Lopez Paiz with use of immigration ID documents not lawfully issued on or about June 29, 2022. The maximum possible penalty if convicted is 5 years’ imprisonment, a $250,000 fine, a three-year term of supervised release, and a $100 special assessment. Count III charges Lopez Paiz with illegal reentry on or about July 14, 2022. The maximum possible penalty if convicted is 2 years’ imprisonment, a $250,000 fine, a one-year term of supervised release, and a $100 special assessment.
* Joseph S. Martin, of Hebron, Nebraska, age 22, is charged in a four-count Indictment. Count I charges Martin with distribution of child pornography between on or about July 12, 2021. The maximum possible penalty if convicted is not less than 15 years and up to 40 years’ imprisonment, a $250,000 fine, not less than five-years’ and up to life term of supervised release, a $100 special assessment, a $40,000 Special Assessment. Count II charges Martin with transportation of visual depictions of minors engaging in sexual explicit conduct between on or about July 12, 2021 and continuing to on or about November 9, 2021. The maximum possible penalty if convicted is not less than 15 years and up to 40 years’ imprisonment, a $250,000 fine, a not less than five-years’ and up to life term of supervised release, a $100 special assessment, and a $40,000 additional special assessment. Counts III & IV charges Marin with possession of child pornography on or about July 12, 2021 and continuing to on or about June 27, 2022. The maximum possible penalty if convicted is not less than 10 years and up to 20 years’ imprisonment, a $250,000 fine, a not less than five-years’ and up to life term of supervised release, a $100 special assessment, and a $17,000 additional special assessment.
* Michael Melgaard, of Alda Nebraska, age 53, is charged in a three-count Indictment. Count I charges Melgaard with production of child pornography between on or about December 3, 2021 and continuing to on or about January 20, 2022. The maximum possible penalty if convicted is not less than 15 years and up to 30 years’ imprisonment, a $250,000 fine, not less than five-years’ and up to life term of supervised release, a $100 special assessment, a $55,000 Special Assessment. Count II charges Melgaard with production of child pornography between on or about December 3, 2021 and continuing to on or about January 20, 2022. The maximum possible penalty if convicted is not less than 15 years and up to 30 years’ imprisonment, a $250,000 fine, not less than five-years’ and up to life term of supervised release, a $100 special assessment, a $55,000 Special Assessment. Count III charges Melgaard with possession and access with intent to view child pornography on or about January 20, 2022. The maximum possible penalty if convicted is 20 years’ imprisonment, a $250,000 fine, a not less than five-years’ and up to life term of supervised release, a $100 special assessment, and a $22,000 additional special assessment.
* Rolando E. Midder, age 43, is charged in a three-count Indictment. Count I charges Midder with sex trafficking of minors by force, fraud, and coercion between on or about February 1, 2022 and continuing to on or about June 27, 2022. The maximum possible penalty if convicted is not less than 15 years and up to life imprisonment, a $250,000 fine, not less than five-years’ and up to life term of supervised release, a $100 special assessment, a $5,000 Special Assessment. Counts II & III charge Midder with sexual exploitation of children between on or about May 22, 2022 and continuing to on or about May 27, 2022. The maximum possible penalty if convicted is not less than 15 years and up to 30 years’ imprisonment, a $250,000 fine, not less than five-years’ and up to life term of supervised release, a $100 special assessment, a $50,000 Special Assessment.
* Daniel Edward Miller, age 41, is charged with possession with intent to distribute 50 grams or more of methamphetamine (mixture) on or about February 20, 2020. The penalty if convicted is not less than 5 years’ and up to 40 years’ imprisonment, a $5,000,000 fine, not less than 4 years and up to a life term of supervised release, and a $100 special assessment.
* Jose Angel Salas, age 30, is charged with conspiracy to distribute and possession with intent to distribute 10 grams or more of fentanyl on or about May 2022 and continuing to on or about June 24, 2022. The penalty if convicted is not less than 5 years’ and up to 40 years’ imprisonment, a $5,000,000 fine, not less than 4 years and up to a life term of supervised release, and a $100 special assessment.

* Juna Sanchez Lopez, age 54, is charged with illegal reentry of a removed alien after having been convicted of a felony on or about June 17, 2022. The maximum possible penalty if convicted is 10 years’ imprisonment, a $250,000 fine, a three-year term of supervised release, and a $100 special assessment.
* Tyrelle Smiley, age 24, is charged with burglary of a United States Post Office on or about November 16, 2019 and continuing to on or about November 18, 2019. The maximum possible penalty if convicted is 5 years’ imprisonment, a $250,000 fine, a three-year term of supervised release, and a $100 special assessment.
* Jake Brian Spiegel, age 41, and Cheryl Ann Gonzalez, age 42, are charged in a three-count Indictment. Count I charges Spiegel and Gonzalez with conspiracy to distribute and possession with intent to distribute 50 grams or more of methamphetamine (actual) on or about December 1, 2021 and continuing to on or about June 13, 2022. The penalty if convicted is not less than 10 years’ and up to life imprisonment, a $10,000,000 fine, not less than 5 years and up to a life term of supervised release, and a $100 special assessment. Count II charges Spiegel with possession with intent to distribute of 50 grams or more of methamphetamine (mixture) on or about June 12, 2022. The penalty if convicted is not less than 10 years’ and up to life imprisonment, a $10,000,000 fine, not less than 5 years and up to a life term of supervised release, and a $100 special assessment. Count III charges Gonzales with possession with intent to distribute of 50 grams or more of methamphetamine (mixture) on or about June 12, 2022. The penalty if convicted is not less than 10 years’ and up to life imprisonment, a $10,000,000 fine, not less than 5 and up to a life term of supervised release, and a $100 special assessment.
* Miguel Vargas Marin, age 33, is charged with illegal reentry of a removed alien after having been convicted of a felony on or about June 17, 2022. The maximum possible penalty if convicted is 10 years’ imprisonment, a $250,000 fine, a three-year term of supervised release, and a $100 special assessment.
