OMAHA, Neb. (AP) - Several states along the Missouri River face an elevated flood risk this spring because the soil remains wet and a significant amount of snow is on the ground in the Dakotas, the National Weather Service said Thursday.

The forecast heightened concerns in areas of Nebraska, Iowa, Kansas and Missouri with levees that still have extensive damage from massive flooding last year and where residents and officials already anticipated some flooding.

"We are very concerned at this point," said Jud Kneuvean, who oversees emergency operations at the U.S. Army Corps of Engineers' Kansas City office.

The weather service said Nebraska, Iowa, Kansas and Missouri and eastern North Dakota and South Dakota face an above-average flood risk this spring. The flood risk is close to normal in Montana and the western half of the Dakotas.

Even in places where the Corps has patched holes in levees that were damaged in last year's flooding, the level of protection may be lower than it was because initial repairs haven't all been done to the full regular height of the levees.

Officials say levee repairs will likely take two years to complete.

The status of levees varies greatly. In Iowa and Nebraska, many of the major levees have been patched, although some breaches remain open. In Kansas and Missouri, much of the repair work has yet to begin.

Part of the problem is that the water remained high for so long in some areas that officials couldn't even assess some of the damage until recently.

In Missouri's hard-hit Holt County, where Tom Bullock serves as emergency management director, repairs have not yet started on the levees that broke and allowed roughly 95,000 acres (38,445.17 hectares) of mostly rural land to flood last spring.

"We're not looking very good for spring," Bullock said.

While most of the breaches around Hamburg, Iowa, have been patched, some repairs probably won't be done before spring, said Fremont County Emergency Manager Mike Crecelius.

"It's not a good outlook no matter how you look at it," Crecelius said.

The Missouri is the longest river in North America, running from western Montana through the Dakotas and touching Nebraska, Iowa and Kansas before cutting across Missouri and entering the Mississippi River at St. Louis. The Corps of Engineers manages the river's flow using six dams and reservoirs in Montana and the Dakotas.

Even if spring weather is mild, some places could still see flooding when the Corps increases releases from upstream dams on the river to prevent the reservoirs from overflowing.

The Corps estimates 2020 runoff will reach 36.3 million acre-feet - the ninth highest out of 122 years - so there will likely be significant water releases from the upriver dams. The highest runoff year was 2011 with 61 million acre-feet, followed by 2019, with 60.9 million acre-feet.

Much of the land in low-lying areas nearest the river is cropland so that often floods first, limiting damage to homes and businesses.

Farmer Gene Walter noted that the private levees that used to protect his cropland north of Council Bluffs, Iowa, remain wide open. Repairs won't be complete in time for typical spring flooding in March. So it could be a day-to-day decision for Walter on which acres to plant.

"You can't even plan or make plans," Walter said. "It's kind of upsetting."

Flooding seems certain for some along the Missouri River

LINCOLN, Neb. (AP) - A bill to ensure more transparency in the death penalty won first-round approval from Nebraska lawmakers Thursday after prison officials blocked the view of public witnesses while carrying out an execution in 2018.

Lawmakers gave the measure first-round approval on a 33-7 vote.

The bill would bar the Nebraska Department of Correctional Services from obscuring the view of witnesses during an execution. It would also require at least two state legislators to serve as witnesses. State law already requires witnesses from media outlets to be present. Relatives of condemned inmates and their victims are allowed to view the execution as well.

Prison officials faced criticism in August 2018 after they pulled the curtains over the media's viewing window for 14 minutes near the end of inmate Carey Dean Moore's execution. Nebraska's corrections director testified before a grand jury that the curtain was drawn "out of respect" for Moore, who was unconscious at the time, and to allow a coroner to determine whether Moore was dead.

National authorities on the death penalty criticized the decision, saying it defeated the purpose of having independent witnesses to ensure the process was carried out correctly.

The bill requires two more votes before it goes to Gov. Pete Ricketts.

Execution transparency bill wins initial OK in Nebraska

COLUMBUS, Neb. (AP) - The president and chief executive officer of Nebraska Public Power District announced Thursday that he intends to leave his post.

A district news release said Pat Pope expects to remain available to aid with the transition to his replacement. The release said it's likely the board of director's executive committee will recommend that Tom Kent replace Pope. Kent is the district's executive vice president and chief operating officer.

Pope joined the district in December 1979 as an electrical engineer and held several positions as he moved up over the years. He became president and CEO in April 2011.

"It has been a pleasure working with Pat, and I wish him and his wife, Jackie, the best in the coming years," said the board chairman, Barry DeKay.

"Some may be surprised with this announcement, but Pat has been talking to the executive committee of the board for the past few months to ensure a smooth leadership transition," DeKay said.

The publicly owned utility includes all or parts of 86 of Nebraska's 93 counties.

Nebraska property tax package advances out of committee

United States Attorney Joe Kelly announced that Sarah Waugh, 30, of North Platte, Nebraska, was sentenced today to 37 months in prison by United States District Judge Brian C. Buescher for possession with intent to distribute methamphetamine. There is no parole in the federal system. Following her release from prison, Waugh will serve three years of supervised release.

On March 12, 2019, officers of the North Platte Police Department conducted a trash pull from Waugh’s residence in North Platte. Information through Crime Stoppers indicated the occupant, Waugh, was selling large amounts of methamphetamine from her home. In the trash, officers found an empty bag with trace amounts of methamphetamine. Officers then obtained a search warrant.

On March 13, 2019, officers served the search warrant on the residence.&nbsp; Waugh was inside the residence.&nbsp; Inside the house was approximately 47.6 grams of methamphetamine.

This case was investigated by the North Platte Police Department and the CODE Drug Task Force.&nbsp;

Local students among fall 2019 graduates of Fort Hays State University

Nebraskans have made property tax relief their number one priority, and it’s my top priority for the Legislature.&nbsp; Senators are now one-third of the way through this year’s short legislative session, with about 40 days to go.&nbsp; Nebraska’s farmers, ranchers, and homeowners are counting on Senators to pass meaningful property tax relief before the session ends.&nbsp;

LB 974 is the main property tax bill under consideration in the Legislature.&nbsp; While its details are still being finalized, I support the bill’s general framework.&nbsp; It satisfies three core principles that must be part of any tax plan that provides real, sustainable relief.

·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;First,&nbsp;no tax increases.

·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Second,&nbsp;protect the Property Tax Credit Relief Fund.&nbsp; The State uses this fund to pay a portion of your property tax bill each year. &nbsp;Senators and I worked together to increase the fund by over 20% last year, and we’ve nearly doubled it during my administration. This money gives property taxpayers direct relief, and it should not be taken for any other purpose.

·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Third,&nbsp;encourage spending restraint in local governments.&nbsp;

This last point is pivotal.&nbsp; The only way to achieve long-term property tax relief is to control spending—at both the state&nbsp;and local levels—while we grow Nebraska’s economy.&nbsp; Over the past six years, we’ve successfully controlled spending at the State.&nbsp; On average, we’ve held budget growth to less than 2.4% annually.&nbsp; While we’ve held spending in check, we’ve also increased revenues through economic growth. &nbsp;Nebraska’s economy exceeded the national rate of growth for 2019, and we’ve won three straight Governor’s Cups for attracting new economic development.&nbsp; This has positioned us to reduce property taxes going forward.

For the property tax plan to work, local governments also have to do their part to control spending.&nbsp; The State of Nebraska does not collect or spend a single penny of property taxes.&nbsp; In fact, the State of Nebraska is constitutionally prohibited from doing so.&nbsp; Property taxes are collected and spent by local political subdivisions like government schools, community colleges, cities, counties, and natural resources districts.&nbsp; Among these, K-12 government schools are the biggest spenders.&nbsp; On average, they are responsible for roughly 60% of Nebraskans’ property tax bills.&nbsp; Over the past 10 years, school property taxes have increased by 54%. &nbsp;Meanwhile, inflation has only gone up 17%, and the median household income in Nebraska has only grown 33%.

Nebraska currently has controls in place to limit a school’s year-over-year budget growth to 2.5%.&nbsp; LB 974 would improve these controls by limiting annual budget growth to the inflation rate, tying it to the Consumer Price Index.&nbsp; That rate has increased between 1-2% per year over the last decade.&nbsp; This common-sense revision links school spending to the ups and downs of the economy instead of permitting school budgets to increase without regard to economic conditions. &nbsp;The Consumer Price Index better reflects the real constraints families and private sector businesses face.

LB 974, the Revenue Committee’s property tax bill, has already received support from urban and rural Nebraskans such as small businesses, the Nebraska Chamber of Commerce, Nebraska Farm Bureau, The Nebraska Cattlemen, and many others.&nbsp; The main opponents to the bill have been K-12 government schools.&nbsp; They’ve argued that the bill shrinks their spending.

School lobbyists are wrong.&nbsp; LB 974 does not cut school spending.&nbsp; K-12 government schools are locally run, and school districts continue to have 100% control of their budgets.&nbsp; School boards have the option to ask voters to override the annual budget growth limitation.&nbsp; Local communities can then decide whether or not it’s necessary to raise more revenues for their government schools.&nbsp; This process doesn’t restrict spending; it makes spending more accountable to the people.

By Governor Pete RickettsNebraskans have made property tax relief their number one priority, and it’s my top priority for the Legislature.&nbsp; Senators are now one-third of the way through this year’s short legislative session, with about 40 days to go.&nbsp; Nebraska’s farmers, ranchers, and homeowners are counting on Senators to pass meaningful property tax relief before the session ends.&nbsp;LB 974 is the main property tax bill under consideration in the Legislature.&nbsp; While its details are still being finalized, I support the bill’s general framework.&nbsp; It satisfies three core principles that must be part of any tax plan that provides real, sustainable relief.·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;First,&nbsp;no tax increases.·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Second,&nbsp;protect the Property Tax Credit Relief Fund.&nbsp; The State uses this fund to pay a portion of your property tax bill each year. &nbsp;Senators and I worked together to increase the fund by over 20% last year, and we’ve nearly doubled it during my administration. Governor's Weekly Column: Delivering Property Tax Relief for Nebraskans

LINCOLN, Neb. (AP) - Law enforcement officers would have to undergo anti-bias training under a bill that lawmakers advanced Wednesday and that could be the last major piece of legislation proposed by Nebraska's longest-serving and best-known state senator.

Lawmakers gave the measure first-round approval on a 43-0 vote. It was introduced by Sen. Ernie Chambers, of Omaha, who designated it as his last official legislative priority bill in what could be his final year in office.

Chambers, 82, is the state's longest-serving state lawmaker, having served a total of 46 years in Nebraska's single-chamber Legislature. He was briefly ousted from office in 2009 due to term limits, but returned after the minimum four-year hiatus and won two more consecutive four-year terms. Term limits will remove him from office again in January for at least four years, and Chambers has declined to say whether he'll run again.

The bill, which must still go through two more rounds of voting before it could go to the governor, would require two hours of anti-bias and implicit bias training as part of the continuing education requirements for local police officers and sheriff's deputies. The Nebraska State Patrol would have to offer training as well to try to prevent racial profiling.

Chambers described the measure as a relatively small "peewee bill," but said it could help prevent the deaths of unarmed black people.

"It will do some good," said Chambers, who is black.

Sen. Patty Pansing Brooks, of Omaha, said the bill may seem small, but she argued that it isn't a "peewee issue," and she praised Chambers for his work in the Legislature.

Sen. Steve Lathrop, of Omaha, said it's important because studies have shown that there is bias in law enforcement, even though it can be unconscious.

Chambers fought for years to abolish the death penalty and succeeded in 2015, but the law he sponsored was overturned by voters after a petition drive partially financed by Gov. Pete Ricketts and the governor's conservative allies.

Under legislative rules, designating a bill as a priority increases the odds that lawmakers will debate and vote on it before the session ends, and proposals that don't get chosen aren't likely to pass. Each senator gets one priority bill per session.

IMPERIAL, Neb. (AP) - Prosecutors have dropped charges against a man accused of involvement in the disappearance and slaying of a woman in southwest Nebraska.

The charges were dropped Tuesday for Russell Mann, of Enders. He'd been charged with two counts of being an accessory. The charges can be refiled later.

The charges stemmed from the disappearance and killing of 22-year-old Annika Swanson and the kidnapping and assault of another woman who's now safe. Two other people - Kevin German, of Colorado Springs, Colorado, and Keonna Carter, of Taylorsville, Utah - have&nbsp;<a href="https://apnews.com/e68a68baac151d9a5abdadb71bfe9447" target="_blank">pleaded</a>&nbsp;not guilty to charges of first-degree murder and kidnapping.

They're accused of leaving Swanson, of Imperial, in a drainage pipe in a Chase County pasture on Nov. 14. Court records say Carter told investigators that German beat up Swanson and, accompanied by Carter, forced Swanson down into the pipe.

Using Carter's information, authorities found and recovered Swanson's lightly clad body from the pipe. Her father had reported her missing three days earlier.

LINCOLN, Neb. (AP) - A bill that would allow more families to qualify for a child care subsidy as they transition out of poverty won first-round approval Tuesday from Nebraska lawmakers.

Senators advanced the measure, 25-7, through the first of three required votes in the Legislature.

The proposal by Sen. Kate Bolz, of Lincoln, would allow recipients to claim "transitional child care assistance" if they earn up to 200% of the federal poverty guidelines, or $52,400 for a family of four. The current eligibility level stops at 185%, or $47,160 for that same family.

Supporters, including some business groups, have said the measure will minimize the so-called "cliff effect" that encourages low-income people not to seek a raise at their jobs because doing so would cause a sharp drop in their public benefits.

NORTH PLATTE, Neb.-The Nebraska State Patrol is investigating an incident in Hitchcock County that included an officer-involved shooting. The incident occurred early Tuesday morning in Trenton, Nebraska.

At approximately 1:10 a.m. today, the Hitchcock County Sheriff’s Office received a 911 call regarding a man shooting a firearm near a residence in Trenton. Deputies arrived at the scene just before 1:30 a.m.

At approximately 1:42 a.m., deputies requested assistance and advised that shots had been fired, striking the subject. Emergency medical personnel from Trenton and Culbertson arrived on scene and transported the subject to McCook Community Hospital. He was then flown to Bryan Health West Campus in Lincoln for further treatment. His condition is stable as of 9:00 a.m.

The Hitchcock County Sheriff’s Office has requested the Nebraska State Patrol conduct the investigation into the officer-involved shooting. Charges stemming from the initial incident are pending with the Hitchcock County Attorney.&nbsp;

No law enforcement personnel were injured in this incident.

Court records say Edward Gonzales, 18, was sentenced Friday to five to 10 years in prison for the escape assault and other crimes last year.

Gonzales have said Gonzales and Luke Cuello&nbsp;<a href="https://apnews.com/590ef040738941cea0e5f2ec4d15466a" target="_blank">attacked</a>&nbsp;a center employee on Feb. 24, 2019, when she was bringing Cuello medication he had requested. The two then freed two other teenagers and escaped.

Cuello eventually was convicted of felony robbery and strangulation and sentenced late last year to one to six years in prison.

Gonzales helped another teen assault a center employee on April 9. They took his keys, freed two other teens and then escaped, authorities said.

In August, the court records say, Gonzales and three other inmates assaulted another inmate at the Buffalo County Detention Center.

Man imprisoned for violent youth center escape, other crimes

SAN DIEGO (AP) - The first confirmed case of novel coronavirus has been found among hundreds of people who were evacuated from China to military bases around the United States, it was reported Monday.

The adult and three other evacuees had been in hospital isolation after showing symptoms of the virus but on Sunday, federal health officials said they had tested negative and they were sent back to the base, where they joined more than 200 people who are under a 14-day quarantine.

On Monday morning, however, officials with the U.S. Centers for Disease Control and Prevention informed county health officials that "further testing revealed that one of the four patients tested positive" for novel coronavirus and the person was returned to hospital isolation, UC San Diego Health said in a statement.

Another evacuee from Miramar also was hospitalized for evaluation Monday afternoon, UC San Diego Health said in a statement.

"Both patients are doing well and have minimal symptoms," the statement said.

This is the seventh confirmed case of novel coronavirus in California and the 13th in the United States.

The person confirmed to have the illness arrived at Miramar last Wednesday from Wuhan. That locked-down city of 11 million is the epicenter of the highly contagious disease, which has killed more than 1,000 people overseas.
