LINCOLN, Neb. (AP) - There have been no cases of the mosquito-borne West Nile virus so far this year in Nebraska, the Lincoln Journal Star reported Sunday.

Jeff Hamik, an insect-transmitted illness expert at Nebraska's health department,&nbsp;<a href="https://journalstar.com/lifestyles/health-med-fit/health/state-seeing-unusual-lack-of-west-nile-disease-this-year/article_f9409da5-c1f3-5229-b43b-3ec31a17cd24.html?utm_campaign=snd-autopilot&amp;utm_medium=social&amp;utm_source=twitter_JournalStarNews" target="_blank">told the newspaper</a>&nbsp;that it's unusual to have no cases by this time in the year.

Hamik said a cool spring might have delayed mosquito breeding, resulting in the longest period without a pool of West Nile-positive mosquitoes in Nebraska history.

Hamik said West Nile cases in people will start cropping up in the next few weeks in Nebraska, but he expects fewer cases than normal in the state this year.

Most people with West Nile virus don't have symptoms, according to the&nbsp;<a href="https://www.cdc.gov/westnile/index.html" target="_blank">Centers for Disease Control and Prevention</a>. It can cause flu-like symptoms and sometimes leads to severe illness, including brain inflammation.

LINCOLN, Neb. — A Colorado man died in a boating accident Saturday afternoon at Lake McConaughy State Recreation Area. A Colorado Springs woman was injured in the same accident.

Kevin Kiesow, 53, of Colorado Springs was taken to Ogallala Community Hospital, where he later was pronounced dead. Kim Lampe, 55, also of Colorado Springs, was admitted to the hospital and is recovering.

Nebraska Game and Parks Commission conservation officers responded to the report of an accident at 3:51 p.m. near Arthur Bay on the lake and found Kiesow being given CPR. According to reports gathered in the investigation, Campe had fallen overboard from a pontoon boat, and Kiesow, her boyfriend, had jumped in to rescue her. He then had to be rescued by others on the pontoon and another boat nearby.

Wind speeds at the time were 15 mph with 20 mph gusts, making lake conditions rough.

Man dies, woman injured in boating accident at Lake Mac

KEARNEY, Neb.-A Kearney man has been arrested after police say he fired at an occupied dwelling.

According to Kearney police, at approximately 10:30 p.m. on Tuesday, August 25, 2020, Kearney Police were called to investigate shots fired at an occupied dwelling in the area of 107 Huron Drive. 

Police say upon arrival officers found a damaged back window of a vehicle parked in the driveway, along with damages on the front of the residence.  Both damages were consistent with being caused by a shotgun, possibly fired from the street toward the residence. At the time of the incident the residence was occupied, there were no injuries reported.   

On September 2, Kearney Police Investigators obtained an arrest warrant for Richard D. Fries, for the charges of shooting into an occupied dwelling, a Class 1C felony and possession of a firearm by a felon, a Class 1D felony. 

 The arrest warrant was served on Fries while he is currently being held at the Lincoln County Jail in North Platte for unrelated charges.

Ander Christensen became an internet sensation after he suggested that Lincoln lead the way in changing the name of chicken wings to "saucy nugs" and various other names.

LINCOLN, Neb. (AP) - In an age of growing divisive political discourse across the country, a Nebraska man is drawing attention for his impassioned plea to take action - against boneless chicken wings.

Video of Ander Christensen's satirical rant before the Lincoln City Council on Monday pleading to ban the "boneless chicken wing" moniker has garnered widespread attention on social media and news sites.

Christensen, who is the son of a council member, made his case that the meat in boneless wings doesn't come from a chicken's wing at all, but from its breast.

"We've been living a lie for far too long," he told the council.

Instead, he suggested the dish could be renamed, "buffalo-style chicken tenders, wet tenders, saucy nugs or trash."

His plea, of course, was for the children.

"Our children are afraid of having bones attached to their meat, which is where meat comes from. It grows on bones!" he said. "We need to teach them that the wings of a chicken are from a chicken, and it's delicious."

Governor Ricketts issues Labor Day Statement

LINCOLN, Neb. (AP) - Nebraska will apply for federal assistance to help workers who were laid off because of the coronavirus pandemic, allowing those who qualify to collect an extra $300 per week, state officials announced Friday.

Nebraska is the last state to confirm that it will seek the extra federal aid. Every other state has said it will apply, except for South Dakota, which refused the money.

The payments are a part of the Federal Emergency Management Agency's lost wages supplemental payment program. People who qualify will receive $300 per week, along with their unemployment benefit, for a limited number of weeks. Once the federal grant funding is exhausted, the program will end.

Only people who are unemployed because of the pandemic will qualify. The program also excludes people who are receiving less than $100 in weekly unemployment benefits.

Nebraska Commissioner of Labor John Albin said his agency is still waiting for federal guidance on how the state can cover the program's administrative costs. Because of that, he said the timeline for issuing payments is uncertain.

With the new assistance, the maximum benefit available to claimants will be $740 per week for the covered weeks, before taxes.

Kearney police are investigating an armed robbery and assault and warrants have been issued for the suspects.

According to police, at approximately 1:17 p.m. on Thursday, September 3, Kearney Police responded to CHI Good Samaritan Emergency Room for an assault/armed robbery report. The adult male victim reported he had been assaulted and robbed at a residence in south Kearney on September 2, 2020, sustaining serious injuries to his face and head. 

With the information provided by the victim, investigators were able to identify two suspects in this case. 43-year-old, white male, Billy P. Herl Sr. and 22-year-old, white female, Jenny F. Cleaveland. Both suspects are believed to be homeless and have been seen panhandling at several intersections in Kearney over the past week. The female has been seen with a small dog and cardboard sign.  

Felony arrest warrants for both suspects have been issued for 1st Degree Assault, Robbery, Use Of a Weapon to Commit a Felony, and Felon in Possession of a Firearm.  Anyone with information on the whereabouts of Herl and Cleaveland are asked to call 911 and not approach the suspects.

LINCOLN, Neb. (AP) - A proposal by University of Nebraska-Lincoln leaders would tackle a more than $38 million budget shortfall by taking half that amount through staff and faculty cuts.

UNL Chancellor Ronnie Green's proposal would eliminate nearly $19 million in faculty and staff positions over the next three years, the Omaha World-Herald&nbsp;<a href="https://omaha.com/news/state-and-regional/unl-proposes-cutting-18-9-million-in-faculty-staff-positions-over-three-years/article_324a0518-a000-5891-b761-abc0e6ce5ca0.html" target="_blank">reported</a>. It would also cut textile, dance and hospitality programs at the school.

Earlier this year, University of Nebraska President Ted Carter said the system's four campuses would need to bake at least $43 million in cuts in total to address a budget shortfall created by the coronavirus pandemic.

UNL's share of that was estimated at $25.8 million, but because of an existing budget shortfall created by lower-than-expected tuition revenue, UNL is looking to cut a total of 8%, or $38.2 million, from its budget in two phases.

The first phase was made earlier this week to trim $16.4 million from UNL's state-aided budget, which is funded through tuition revenue and state appropriations. It eliminated 60 nonacademic positions and enacted $6.9 million in operational savings.

The second phase seeks to slash $22.6 million, including $15.8 million in filled and vacant faculty positions and $3.1 million in staff positions. Another $2.7 million is proposed in library and graduate student and student worker cuts.

Michael Dycus is challenging a district court judge's decision to approve the divorce, contending that his wife didn't give a valid reason why their 33-year marriage failed. In oral arguments before the Nebraska Supreme Court, his attorney argued that the state's no-fault divorce law violates the state constitution because it doesn't allow him the same due-process and equal-protection rights that he's guaranteed in other types of court cases.

"One party will receive a divorce by testifying that in spite of efforts to save it, (the marriage) is irretrievably broken," Dycus' attorney, Robert Sullivan, said in his arguments before the court. "The other party cannot stop that. It's like trying to hold back an avalanche."

Nebraska's no-fault divorce law, approved in 1972, allows judges to dissolve a marriage if both spouses declare that the marriage is "irretrievably broken," or if one spouse makes that statement and the other doesn't deny it.

If one spouse disputes that the marriage is beyond saving, the judge is then required to consider what prompted the divorce filing and the chances that the marriage can be salvaged before issuing a ruling.

The case before the court is widely viewed as a long shot, but it's caught the attention of religious liberty groups who argue that judges should have to order counseling or mediation if one spouse requests it.

"I've been a lawyer for 31 years, and I've never seen this come up," said Robert Parker Jr., an attorney who represented Dycus' wife, Debra Dycus, in the divorce proceeding.

All states allow some form of no-fault divorce, but Nebraska is one of 17 that offer it as the only option. Fault divorces require one spouse to allege that the other destroyed their marriage through infidelity, abuse or other damaging acts. Critics say fault divorces encourage spouses to lie under oath and make it harder to end a failed marriage.

Parker said he considers the appeal so far-fetched that he withdrew as Debra Dycus' attorney in January, after her husband appealed, because he felt badly charging her for representation in what he considers an open-and-shut case. No one appeared on her behalf on Thursday to argue her side before the high court.

"I can't imagine that they're going to touch a 48-year-old no-fault divorce statute," Parker said. "I'd be absolutely shocked. God forbid that a woman be able to get rid of a man without having to show that he beat her or cheated on her."

One high-court justice raised a similar sentiment during Thursday's oral arguments.

"This is a statute that's been on the books for longer than I've been a lawyer," said Justice William Cassel. "Isn't it curious that it's being brought up at this point in time?"

Some conservative, religious freedom groups argue that the issue gained new relevance following the U.S. Supreme Court's 2015 decision to allow gay marriage nationwide. Sullivan noted that the majority opinion described marriage as "a profound union" and one of society's oldest institutions.

"Why is it that marriage is held up as such a fundamental right, and yet it's so simple to get out of?" he said.

Sullivan said Michael Dycus is pursuing the case because he objects to divorce on religious grounds and he believes that society isn't treating marriage with the seriousness it deserves.

Nebraska's no-fault divorce law allows one spouse to declare the marriage dead, and the courts "rubber stamp that" without giving the other spouse an adequate chance to argue why it should be preserved, said Matthew Heffron, an attorney for the Thomas More Society, which filed a brief urging the court to strike down Nebraska's law.

Nebraska does allow a spouse who objects to argue why the divorce shouldn't be granted, but Heffron said it's often just a formality.

A phone message left with Michael Dycus wasn't immediately returned.

Deb Dycus declined to comment on the personal aspects of her divorce but said in an emailed statement that the case has no merit. She said she has been a practicing Catholic her entire life but considers her divorce a civil issue that has been publicly framed as a religious matter.

"Although it was not needed, more than two years ago I sought and was granted permission by the bishop of my diocese to approach the civil courts to settle the civil effects of a divorce," she wrote.

Parker said most couples in Nebraska who don't have minor children can get a divorce in about three months if they're willing to cooperate. The Dycuses have children, but they're all grown. Debra Dycus filed for divorce more than a year ago and likely won't see a resolution until the Supreme Court rules.

"It's a pain in the butt," Parker said. "She's miserable. She just wants to be divorced."

LINCOLN, Neb. – The Nebraska Game and Parks Commission, along with Ducks Unlimited, are again challenging waterfowl hunters to participate in the Nebraska Duck Slam.

The slam challenges hunters to harvest a teal (blue-winged or green-winged) of either sex, as well as drakes of three other species: an American wigeon, a mallard and a northern pintail. 1-mile run. All throughout the month of September participants will
be able to register and complete their races whenever they choose,
whether it’s on the track, trail or treadmill! The cost is $25 per
participant which includes a long sleeve t-shirt and a medal.

to combat the spread of COVID-19, mitigate the economic impact of the
pandemic or have experienced financial difficulty as a result of the

OMAHA, Neb. (AP) - The University of Nebraska at Omaha has quarantined four of its sports teams after some athletes tested positive for the coronavirus, even as data show the state approaching 400 COVID-19 deaths.

UNO shut down workouts and quarantined members this week of its men's basketball, women's softball, men's baseball and women's volleyball teams, the Omaha World-Herald&nbsp;<a href="https://omaha.com/news/local/education/four-uno-sports-teams-quarantined-after-athletes-test-positive-for-covid-19/article_1c566098-0623-5a01-9b2a-405072596df2.html#tracking-source=home-top-story-1" target="_blank">reported</a>. That came after the results of 13 UNO athletes who were tested on Friday came back positive for the virus.

News of UNO's outbreak comes as colleges around the country deal with rising case numbers as schools try to reconvene for the fall.

None of the UNO athletes who tested positive have shown any symptoms, UNO Chancellor Jeffrey Gold said Wednesday.

Each of the four teams had at least two athletes who tested positive, Gold said. Through Tuesday, 38 students and nine employees had tested positive at UNO. The University of Nebraska-Lincoln reported 245 positive results among students, faculty and staff through August.

The state's online tracker shows that as of Thursday, nearly 35,000 people have tested positive for the virus and 399 have died from it. The 7-day rolling average of daily new cases in Nebraska has risen over the past two weeks from 256.43 new cases per day on Aug. 19 to 318 new cases per day on Sept. 2.

WCDHD reports 4 new positive COVID-19 cases on Wendesday, remove another positive case from count

State Treasurer John Murante thanked Governor Pete Ricketts for issuing a proclamation declaring September ‘College Savings Month’ in Nebraska.

Studies have shown that planning early and having a dedicated savings plan - such as Nebraska’s NEST529 account - can dramatically increase a child’s chances of achieving the dream of higher education.

The declaration reads, in part, “We recognize the challenges ahead as we strive to make sure that our children have the education, knowledge, and skills needed to excel and to become contributing members of our state’s strong, vibrant workforce.”

The declaration continues that it “is in the best interest of the State of Nebraska that access to post-secondary education, including community colleges and technical schools, be available for all our children. Encouraging parents to save for their children’s education promotes the public purpose.”

“Choice in education helps empower the next generation of Nebraskans to achieve their dreams,” said Gov. Ricketts. “College Savings Month highlights the importance of saving and planning ahead, which will help give your kids more options as they pursue the education or vocational training program of their choice.”

“This College Savings Month, as students embark on the next step of their educational journey, we are reminded that their bright futures in higher education are right around the corner and it is wonderful that people are still thinking about their children’s future.
